1. Introduction
Welcome to Uptomic ("Uptomic", "we", "our", or "us"), operated by Uptomic SRL.
These Terms of Service ("Terms") govern your access to and use of Uptomic (the "Service").
By creating an account, accessing, or using the service, you agree to these Terms.
These Terms apply in addition to any separate Non-Disclosure Agreement, pilot agreement, subscription terms, or other written agreement you may have accepted as part of any other Uptomic discussion.
2. Nature of the Service
- The service may be offered through limited access, early access, pilot, preview, or generally available plans.
- Features may be incomplete, experimental, or changed without notice.
- Access is granted for your personal career use, evaluation, and feedback unless otherwise agreed in writing.
- Uptomic may modify, suspend, or discontinue access at any time.
3. Eligibility
You must be at least 16 years old to use the service in countries subject to GDPR.
You must be at least 13 years old from any other country.
By participating, you represent that you are legally permitted to enter this agreement and comply with all applicable laws.
4. Account and Access
Uptomic requires an account for secure access and use. Authentication is handled via Clerk.
- You are responsible for maintaining the confidentiality of your account credentials.
- You may not share or transfer your account without our consent.
- We may revoke or limit access at any time, especially for misuse, security risks, or breach of these Terms.
5. Acceptable Use
You agree not to:
- Share confidential features, screenshots, or materials when they are covered by an NDA or written restriction.
- Upload unlawful, harmful, or infringing materials.
- Attempt to reverse engineer, copy, or resell the service.
- Interfere with or attempt to bypass security controls.
6. Feedback
By submitting feedback, bug reports, or suggestions, you grant Uptomic a worldwide, royalty-free, perpetual license to use that feedback to improve our products and services.
Feedback does not entitle you to compensation or ownership rights.
7. Intellectual Property
- All content, designs, software, and documentation are owned by Uptomic SRL.
- You retain ownership of documents, profile information, and other content you upload to the service.
- You receive a limited, non-exclusive, revocable license to use the service for your personal use unless otherwise agreed in writing.
- You grant Uptomic a limited license to host, process, analyze, display, and transmit your uploaded content solely to provide, secure, support, and improve the service as described in the Privacy Policy.
- You may not reproduce, distribute, or create derivative works without written permission.
8. Career, Job, Salary, and AI Information
Uptomic provides career intelligence, job-market insights, salary estimates, role recommendations, application materials, AI-generated outputs, and related guidance for informational purposes only.
Uptomic does not guarantee that you will receive a job offer, interview, promotion, salary increase, compensation level, career outcome, immigration outcome, licensing outcome, or any other professional result. Actual outcomes depend on many factors outside Uptomic's control, including your experience, qualifications, location, job-market conditions, employer decisions, interview performance, compensation practices, and your own actions.
Salary estimates, job matches, AI-resilience scores, recommendations, and similar outputs are estimates only. They may be incomplete, outdated, inaccurate, or not applicable to your specific circumstances. Job recommendations may not reflect every available opportunity in the market.
You are responsible for independently reviewing, validating, and deciding whether to rely on any recommendation, analysis, document, or other output before using it.
Uptomic does not provide legal, financial, tax, immigration, employment, recruiting, or professional-licensing advice.
9. Data Handling and Privacy
Your use of the service is governed by our Privacy Policy.
Uptomic processes personal data as described in the Privacy Policy and in accordance with applicable data-protection requirements.
Some data may be processed by third-party providers under appropriate data-protection agreements.
10. Fees, Subscriptions, and Refunds
The service may be provided without subscription fees unless we agree otherwise in writing. If Uptomic introduces paid subscriptions, billing terms, renewal terms, cancellation options, and any refund policy will be presented before you are charged.
11. No Warranties
The service is provided "as is" and "as available."
Uptomic disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Uptomic does not warrant that the service will be uninterrupted, error-free, or available at any particular time.
12. Limitation of Liability
To the maximum extent permitted by law:
- Uptomic's total liability for any claim related to the service shall not exceed EUR 100.
- Uptomic shall not be liable for indirect, incidental, or consequential damages, including data loss or missed opportunities.
13. Termination
Uptomic may suspend or terminate your access at any time.
Upon termination, you must cease using the service.
Account data, uploaded content, and retained records are handled as described in the Privacy Policy.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Belgium, without regard to its conflict-of-laws rules.
Any dispute relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium, except where mandatory law grants you the right to bring proceedings in another forum.
